Introduction and Analysis of Mandatory Child Abuse Reporting Laws
The Hong Kong Legislative Council recently passed the "Mandatory Reporting of Child Abuse Ordinance," which will come into effect on January 20, 2026, following an 18-month preparatory period. This ordinance requires certain professionals to report suspected cases of serious harm to children under 18. It defines severe harm broadly, including both physical and psychological injuries, neglect, and coerced sexual activities. The ordinance also specifies scenarios in which reporting is not required, offers immunity to reporters under certain conditions, and mandates the creation of guidelines to support accurate reporting. Non-compliance may lead to fines or imprisonment, and protections exist to safeguard reporters from obstruction or identity exposure.
